Court dismisses Dino Melaye's suit to end recall process; orders continuance of recall within two weeks

A Federal High Court sitting in Abuja, Nigeria’s capital on Monday, dismissed a suit by Senator Dino Melaye (Kogi West) challenging his recall process, instituted by his constituents.
Justice Nnamdi Dimgba who presided over the matter ruled that the Independent National Electoral Commission, INEC, “shall proceed with the recall process.”
The Senator had approached the court seeking an order to nullify the recall process.
the court then ordered INEC to halt the recall exercise, pending the determination of Melaye’s application.
Melaye argued that he was not given a fair hearing in the case but presiding Justice Dimgba said the Constitution does not require a special provision that mandates INEC to grant the lawmaker an opportunity for fair hearing.
The court ordered INEC to serve the lawmaker with the recall petition, schedule of signatures attached to the petitions, and a full list of persons in support of the recall process.
Justice Dimgba held that his order must be executed within two weeks before an amended timetable for the recall would be made.
