Independent National Electoral Commission (INEC) chairman, Mahmood Yakubu, has appealed against the ruling of an Abuja federal high court which gave a warrant for his arrest.
In the appeal filed by Mr Adegbeoyega Awomolo (SAN), on behalf of the INEC boss and made available to newsmen, Thursday, Yakubu challenged the locus of the arrest warrant against him by the court.
Yakubu insisted that his arrest warrant was trite based on the fact that it was premised on defective and shaky legal ground.
He prays the court to use its powers to quash the arrest order made by Justice Stephen Pam.
In a bench warrant for the arrest of the INEC boss issued on August 8, 2018, justice Stephen Pam said he deems it fit to order the arrest of Yakubu based on contempt of court.
The order followed Mr Yakubu’s failure to honour summons by the court to appear before it in respect of a suit involving the Anambra chapter of Peoples Democratic Party (PDP).
The INEC chairman had between July 5 and July 10 allegedly failed to honour the court’s summons to defend a contempt proceeding.
