Bokkos LG congress: court fixes 4th Oct for hearing

A state high sitting in Jos Division has adjourned to the 4th of October, 2021 for a hearing on the preelection matters between the All Progressives Congress, APC, Hon Joseph Guluwa and Plateau State Independent Electoral Commission, PLASIEC, scheduled for 10th Oct, 2021 LG poll for the adoption of all processes.

Justice Godfrey Kamyil of court NO 9 of West of mines Jos orders the claimant/respondent to effect proper service on the 1st defendant (APC) before the 4th October deadline.

The judge stated that, “I observe that the first defendant was not served with the service so for that the court should effect fresh service by placing at the APC secretariat on pre-hearing date.

However, when counsel, the claimant Barr. Munir B. Abdullahi sought for cost on withdrawal of counter affidavit but the judge said no cost at this pre-hearing stage.

Hon Peter Best Mallo in a suit NO PLD/J/327M1 /2021 challenged the Nomination of Joseph Guluwa as the flag bearer of the APC in Bokkos LGA by seeking an interims order to maintain the status quo until the determination of the case.

Hon Peter Best Mallo approach the vacation judge, Justice Ishaku Kunda, there is already an existing order for parties to maintain the status quo.

Therefore, the election into the Chairmanship of Bokkos LGA candidature of the APC candidate should be suspended for now and we are expected that judgment will be delivered before the election.

Barr. Munir told the court that the matter was slated for mentioning and seek the court order for a short date to hear on the suit because time is of the essence and Nantok Dasuwar counsel to the 2& 3 defendants said they’re not opposed to the application brought by the respondent.

“You recalled that Claimant counsel asks for 30,000.00 costs for withdrawal as they have filed a counter-affidavit in response to objections raised by objectors.
