Atiku resumes legal battle against Tinubu’s presidential victory

The presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, has formally filed a petition at the Presidential Election Petition Tribunal against the declaration of Bola Tinubu of the All Progressives Congress (APC) as President-elect.

In his petition marked: CA/PEPC/03/2023, Atiku seeks that the tribunal set aside Tinubu’s victory and declare him the winner of the February 25 presidential election.

He listed the Independent National Electoral Commission( INEC); Tinubu; his running mate, Senator Kashim Shettima, and the APC as the 1st to 4th respondents.

The petition is coming hours after the presidential candidate of the Labour Party, (LP), Mr. Peter Obi filed his.

The petitioners are praying for the tribunal to declare that Tinubu was not duly elected by a majority of the lawful votes cast at the election.

They want an order mandating INEC to retrieve the certificate of return issued to the APC candidate or in the alternative conduct a fresh election.

Atiku and the Peoples Democratic Party (PDP) had on March 15 2023, filed a notice of discontinuance and notified the court of their withdrawal of an application they filed to compel the Independent National Electoral Commission (INEC) to allow their agents to participate in the process of sorting out ballot papers that were used for the February 25 presidential election.

Neptune Prime reports that the presidential candidates of the PDP and Labour Party have rejected the outcome of the February 25 presidential election in which Bola Ahmed Tinubu, candidate of the ruling All Progressives Congress (APC) was declared the winner by INEC.
