Battle for 2023 presidency continues as Tinubu seeks dismissal of Atiku’s petition

President Bola Tinubu has filed a motion with the Supreme Court to dismiss the appeal put forth by former Vice President Atiku Abubakar and the Peoples Democratic Party (PDP) challenging his victory in the 2023 presidential election.

The President claimed that the petition was abusive in nature and requested that it be dismissed.

Tinubu also maintained that Atiku and his party failed to provide evidence for their allegations and submissions at the tribunal.

The President insisted that the tribunal was accurate in arriving at its verdict and confirming his win.

He urged the apex court to affirm the decision of the lower court, dismissing the appeal in its entirety for lack of merit.

Atiku and the PDP had filed a petition in response to Tinubu’s victory in the presidential election held on February 25, 2023.

They expressed their concerns about irregularities and substantial non-compliance with the Electoral Act, alleging that Tinubu and his running mate, Kashim Shettima, were unqualified to contest and didn’t win the election by a majority of lawful votes cast.

On September 6, the Presidential Election Petition Tribunal (PEPT) dismissed Atiku’s allegations, stating that he failed to prove his case.

Subsequently, on September 18, 2023, the PDP candidate filed an appeal before the Supreme Court.

In the 35 grounds notice of appeal, the appellants submitted that the tribunal’s findings were made with “grave errors and gross misrepresentation,” leading to a miscarriage of justice.

The appellants are requesting that the Supreme Court set aside the entire findings and conclusions of the tribunal.
