Imo State: Court orders NLC, TUC to halt industrial action pending ruling

The National Industrial Court in Owerri, the Imo State capital, issued a fresh injunction order restraining organized labour from further industrial action in the state until the substantive suit is resolved.

Justice Nelson Ogbuanya granted the order on Friday after considering the arguments from both parties’ counsels, who reported being unable to reach a settlement on their dispute.

The defendants named in the suit (No. NICN/OW/41/2023) are the Nigeria Labour Congress (NLC), Secretary-General Emmanuel Ugboaja, the Trade Union Congress (TUC), and its Secretary-General Nuhu Toro.

The claimants in this case are the Attorney General of Imo State and the Imo State Government.

During the hearing on the motion for an interlocutory injunction, the court scheduled the ruling for November 30, 2023.

Emphasizing the importance of preventing the escalation of labour disputes, the court stressed the need to safeguard the interests and well-being of citizens not directly involved in the pending dispute.

Consequently, the court issued an injunction prohibiting the defendants from organizing any strike or industrial action in Imo State until the ruling on the interlocutory injunction motion is made.

It warned about the implications of disobeying the current court order, in accordance with the provisions of order 63 rule 4 of the court’s rules.

The matter has been adjourned to November 30, 2023, for the ruling on the motion for an interlocutory injunction.
