Alleged rights violation: Nigerian Law Society reports CAC Registrar General to Tinubu, AGF, NHRC

The Nigerian Law Society (NLS) has lodged a formal complaint against Hussaini Ishaq Magahi, SAN, Registrar General of the Corporate Affairs Commission (CAC), accusing him of violating the rights of its members. The NLS has called on President Bola Tinubu, the Attorney General of the Federation (AGF), and the National Human Rights Commission (NHRC) to address these allegations.

The NLS, which the CAC claims is operating without official registration, faces opposition from the Nigerian Bar Association (NBA). Recently, Magaji sought approval from the AGF to prosecute the NLS and other unregistered entities, while the CAC issued a public notice declaring the NLS’s activities illegal.

In a letter dated August 22, 2024, addressed to President Tinubu and copied to the NHRC and AGF, the NLS accused Magaji of using the Police to harass its members instead of awaiting the resolution of an ongoing lawsuit at the Abuja Division of the Court of Appeal. The letter, signed by the NLS President and General Secretary, criticises Magaji for bypassing legal channels and resorting to petitions to the DSS, Nigerian Police, and the Nigerian Communications Commission (NCC) to shut down the NLS’s office and website.

The NLS also highlighted that Magaji’s actions contravene legal principles, as he is an appellant in a pending case at the Court of Appeal. The case concerns a Federal High Court judgment that ordered the CAC to register the NLS, asserting that Section 40 of the 1999 Constitution, which allows for the formation of associations, supersedes the Companies and Allied Matters Act (CAMA) 2020.
