Appeal Committee nullifies NBA Damaturu Branch election outcome

The NBA Branch Elections Appeal Committee (North), chaired by Abdul Atadoga Ibrahim SAN, convened on Wednesday, August 14, 2024, to review petitions against the decision of the NBA Damaturu Branch Electoral Committee. The committee reached the following conclusions:

1. The Nigerian Bar Association Damaturu Branch election conducted on August 10, 2024, which was not in compliance with the NBA Constitution, is hereby declared null, void, and of no effect. The election results are set aside.
2. The purported return by the Electoral Committee led by Usman Nuhu Lukman, and all individuals purportedly returned, including or known as M. M. Ngumurumi, Esq., as the Executive Committee of the Damaturu Branch that emerged on August 10, 2024, are directed not to present themselves as the Executive Committee members of the NBA Damaturu Branch henceforth.
3. The invocation of the doctrine of necessity to conduct the election is wrongful and not recognized by the Constitution of this noble Association. There is no provision in the law that empowers any individual, group, or branch to bypass any of the requirements of the election guidelines for qualification. This is particularly emphasized in Article 15(3) of the Uniform Bye-Laws for Branches.
4. It is the recommendation of this Appeal Committee that the President of the Nigerian Bar Association appoint a Caretaker Committee.
5. All other petitions arising from the Damaturu Branch shall comply with the decision of this Committee.
6. Any further attempts by the individuals led by M. M. Ngumurumi, Esq., to present themselves as the Executive Committee of the NBA Damaturu Branch should be referred to the Legal Practitioners Disciplinary Committee.
