A State High Court sitting in Zaria, Kaduna State, has dismissed an application restraining the coronation of the 19th Emir of Zazzau, Alhaji Nuhu Bamali slated for 9th, November 2020.
The Counsel to the plaintiff Ustaz Yunus Usman, SAN had earlier requested in his application dated that 16 October 2020, for an order of interim injunction restraining the governor of Kaduna state from installing, crowning, recognizing and dealing with any person whosoever as Emir of Zazzau.
He also sought for an order to stop the governor from performing any ceremony for the purpose of installing any person as emir of zazzau pending the hearing and determination of the motion on notice.
The application also requested for an order of interim injunction to restrain Ambassador Ahmed Nuhu Bamalli from Parading himself as the Emir of Zazzau pending the hearing and determination of the Motion on notice.
However, in his one-hour ruling on Friday, the presiding judge, Justice Kabir Dabo, dismissed the plaintiff’s request, noting that the refusal to grant the application was in the best interest of the emirate and its subjects.
”The sole issue for determination is whether at this stage it will be in the interest of justice to grant this application. The answer is no.
“The refusal of the court to grant the plaintiff his request was in the interest of peace and Security and to avert any possible crisis in the Emirate.”
The court held that granting the application could create a vacuum in Zazzau emirship stool which would not go down well with the subjects of the emirate and could ignite a crisis in the domain.
Consequently, Justice Dabo adjourned the case to November 18, 2020, for an accelerated hearing of the substantive suit.
Bamali, a former Nigerian Ambassador to Thailand was appointed by the state government following the death of the 18th Emir of Zazzau, Alhaji Shehu Idris, in September this year.
The new Emir is from the Sulubawa dynasty in the Zazzau Emirate Council and arrangements are in top gear for the coronation of the new Emir of Zazzau scheduled to hold on November 9, 2020, in Zaria.
