Court dissolves 3-year marriage due to lack of care, respect

An Upper Area Court in Kubwa, Abuja, has officially dissolved a three-year-old marriage between Hauwau Hamza, a housewife, and her husband, Yahaya Mohammed. The marriage came to an end due to allegations of a lack of care and respect.

Judge Muhammad Wakili, acting in accordance with Islamic Law, granted Hamza’s request for a divorce based on these grounds. Furthermore, Wakili ordered Hamza to return the N60,000 dowry that Mohammed had paid during the marriage.

The judge referred to the Islamic law book, Tuhfatul Hukkam, particularly pages 93 and 94, which state that gifts given to a wife by her husband, such as clothes or jewelry, cannot be reclaimed by the husband.

Wakili made it clear that Mohammed’s request for N100,000 for the clothes he bought for his wife was not valid. However, he did instruct Hamza to observe the “Iddah,” a three-month waiting period, before entering into another marriage.

Mohammed had initially demanded N160,000 from Hamza as a condition for granting her the divorce. He insisted that she must also find him a new wife.

In response, Hamza maintained that her dowry was only N60,000 and disputed Mohammed’s claim that he had spent N160,000 on her. She suggested that if he wanted reimbursement, he should consider the satisfaction she provided during their marriage, including cooking for him.

In a tit-for-tat, Mohammed argued that he had also taken care of her feeding and welfare during their marriage.
