Former INEC Chairman, Attahiru Jega, calls for amendments to Electoral Act

During a two-day retreat organized for senators by the National Institute for Legislative and Democratic Studies (NILDS) in Ikot Ekpene, Akwa Ibom State, Nigeria’s former Independent National Electoral Commission (INEC) chairman, Professor Attahiru Jega, highlighted the need for further amendments to the Electoral Act of 2022.

While acknowledging that the current electoral law is a significant improvement, he emphasized that it is not without imperfections and called for changes to eliminate ambiguities, clarify sections, and strengthen the electoral process.

Jega proposed several key amendments to the Electoral Act:

Mandatory Electronic Transmission of Results: He urged that the electronic transmission of election results should be made compulsory starting from the 2027 general elections. This move would enhance transparency and reduce the potential for manipulation.

Depoliticize INEC Appointments: Jega advocated for the removal of the President’s power to appoint the Chairman and National Commissioners of INEC, in order to promote impartiality and reduce the perception of political influence on the commission.

Timely Resolution of Election-Related Cases: Jega suggested a review of the law to ensure that all election-related disputes are resolved and judgments are made before the date of swearing-in, especially for elected executive positions.

Inclusion of Diaspora Voting: He recommended introducing diaspora voting, at least for presidential elections, to enable citizens abroad to participate in the electoral process.

Enhanced Gender Inclusion: Jega called for the inclusion of more women, possibly up to 35%, in elective positions in parliament and on the candidate lists of all political parties.

Restrictions on Cross-Carpeting: Cross-carpeting by elected officials, including members of the National Assembly, governors, and local government chairmen, should be prohibited, and INEC should be empowered to prepare for elections to fill vacancies caused by such acts.

Tightened Candidate Qualifications: The legislation should allow for stringent conditions for candidate withdrawal and replacement to prevent abuse. INEC should have the authority to screen and, if necessary, disqualify candidates with forged credentials or evidence of criminal behaviour.

Public Scrutiny of Nominees: Jega proposed a transparent process for appointing INEC officers. A joint committee of the National Assembly should handle the responsibility, considering criteria such as knowledge, skills, good character, and non-partisanship, and applicants/nominees should be subject to public scrutiny.

These proposed amendments aim to enhance the integrity, transparency, and fairness of Nigeria’s electoral processes and ensure a more inclusive democracy.
