How 57-year-old doctor sexually assaulted, gave minor contraceptive 

A prosecution witness, Dr Akinbunmi Oyebimpe, on Wednesday narrated to the Lagos State Domestic Violence and Sexual Offences Court in Ikeja how 57-year-old medical director, Dr Olufemi Olaleye, sexually assaulted and forced his victim to take pills to prevent pregnancy.

The witness, who is a medical doctor in Family Medicine at the Lagos State University Teaching Hospital (LASUTH), also told the trial judge, Justice Ramon Oshodi, that the result of the medical examination he conducted on the survivor confirmed injuries consistent with repeated, forceful and blunt penetration of her vagina.

Olaleye, who is the founder of Optimal Care Centre was arraigned before the court on an alleged two-count charge of defilement and sexual penetration against a minor.

The defendant allegedly committed the offences between February 2020 and November 2021 on Layi Ogunbambi Close, Maryland, Lagos.

The prosecution claimed that the offences violated sections 137 and 261 of the Criminal Laws of Lagos State, 2015.

The defendant, however, pleaded not guilty to the charge.

At the resumed hearing of the matter yesterday, Dr Oyebimpe, who is the fifth prosecution witness, told Justice Oshodi that the survivor was referred to the hospital by the Gender Section of the Lagos State Police Command, Headquarters, Ikeja, with a complaint of repeated sexual abuse since March 2020 by her aunt husband, Dr Olaleye.

The medical doctor while being led in evidence by the Lagos State Director of Public Prosecutions (DPP) Babajide Martins, said that the survivor was presented at the hospital on March 15, 2022, along with her aunt.

During the medical history taken by the team, the witness added that the survivor told them the defendant usually calls her at night and that he will remove his trousers and tell her to perform oral sex on him.

The medical expert went on to say that the survivor told her, “He (the defendant) sometimes put his fingers in her vagina, then he applies a lubricant on her vagina and will penetrate her with his penis. She said it happened about four times and that he gives her pills to take afterwards and he would threaten her that she would die if she tells anyone.”

The witness said it was after the medical history was taken that an examination was carried out on the survivor.

She further stated, “after the examination, the major findings were in the genital area. The hymen was angular which means ring-shaped and slightly estrogenic.

“There was a notch at the 9 ‘ O’clock position on the hymen and transaction at one ‘O’clock position at the hymen. Transaction means a deep cut.

“The vagina wall was also unduly visible, revealing more than one-third of the lower vagina.

“The pattern of injury that I saw was consistent with repeated forceful penetrative injury into the vagina. It is an indication of ongoing forceful blunt penetration of the vagina.

“In my medical opinion, if there is a repeated penetrative forceful injury on the vagina, it would be the classical features I saw on the vagina and hymen because it has been ongoing,” the witness alleged.

However, under cross-examination by the defence counsel, Babatunde Ogala (SAN), Dr Oyebimpe clarified that the survivor was already 18 years old at the time of the medical examination.

She also said she couldn’t verify from her findings whether the bruises were caused by the defendant or when the alleged defilement started or ended.

Earlier, the fourth prosecution witness, Inspector, Esther Igbineweka testified that she took the defendant’s statement in April 2022, where he denied the allegations.

During her cross-examination, Igbineweka admitted that she was aware that the defendant had also alleged in his statement that the survivor was having sexual intercourse with one Meschach who was working for the Olaleyes at the time. But, she added that she couldn’t investigate it any further because he was nowhere to be found.

The police officer also said that she didn’t view the contents of the CCTV footage which Dr Olaleye had presented to the Police of the alleged sexual encounter between his wife’s niece and Meshach.

Justice Oshodi has adjourned the matter to January 26 for the continuation of the trial.
