Nigeria Customs implements advance ruling operating procedure

In a significant development, the Nigeria Customs Service (NCS) has recently introduced a Standard Operating Procedure (SOP) for the implementation of Advance Ruling.

This pivotal decision was reached during the 6th Management Meeting of the NCS, convened on August 23, 2023. The foundation for this SOP is rooted in Section 24, sub-sections 1-9, of the new NCS Act of 2023, as well as Article 3 of the World Trade Organization (WTO) Trade Facilitation Agreement (TFA).

Advance Ruling is a concept wherein the Customs Administration offers a written decision, upon request from the importer, regarding the valuation, tariff classification, or origin of goods before they are imported.

This strategic move by the NCS is aligned with the core principles outlined in the Revised Kyoto Convention of 2006 and the WTO Trade Facilitation Agreement of 2017.

Advance Ruling has emerged as a valuable tool for trade facilitation, offering advantages to both Customs administration and traders alike. It significantly enhances predictability and certainty in Customs treatment for goods.

Furthermore, this procedure fosters cooperation and instills confidence between Customs and traders, all within the framework set out by the World Customs Organization Safe Framework of Standards.

The NCS is actively encouraging stakeholders to leverage this innovative initiative. The application process will be streamlined and automated, seamlessly integrated into the Nigeria Customs Service Trade Portal, in line with international best practices.
