Court declares deposed Kano Emir, Lamido Sunusi’s banishment unlawful

The Federal High Court sitting in Abuja on Tuesday ruled that the banishment of the deposed Emir of Kano, Sunusi Lamido Sunusi to Awe Nassarawa State was illegal, unlawful and unconstitutional.

In her ruling on Tuesday, Justice Anwuli Chikere stated that the restrictions placed on Sunusi Lamido Sunusi after his deposition on March, 9th 2020 on the allegations of insubordination are a clear arbitrary violation of his price to freedom of movement and personal liberty granted by the Nigerian Constitution.

Price Lateef Fagbeyinmi SAN, counsel to Sanusi had argued that his client was moved out of Kano to Abuja and later to Awe in Nassarawa State against his wish.

The Judge, therefore, held that the right to freedom of liberty and personal dignity granted under section 34 under the Nigerian Constitution cannot be taken away as was done by the Kano State Government, the Police department of State Security, DSS and Attorney General of the Federation except by the express order of the court.

The judge subsequently voided the arrest, harassment and banishment of Sanusi to Abuja and later to Nassarawa State and set it aside on grounds of being an infringement of his fundamental human right.

The sum of 10 million was awarded to the Emir as damages to be paid by the respondent; the court also directed the respondent to apologise in two national dailies for the embarrassment caused to the Emir.
