Election petition against Tinubu, APC dismissed as APP withdraws case

The Action Peoples Party (APP) has withdrawn its petition challenging the emergence of Senator Ahmed Bola Tinubu of the All Progressive Congress (APC) as the President-elect in the 2023 Presidential election.

The court has also adjourned the petition against the President-elect, Bola Tinubu, filed by the Labour Party and its presidential candidate, Peter Obi, to next Wednesday, May 17.

During the court session, the parties involved in the petition requested an adjournment, and the court granted their request.

The APP’s counsel, Obed Agu, presented a motion on notice, dated and filed on May 9, indicating the party’s intention to withdraw suit number CA/PEPC/02/2023, in accordance with paragraph 29, subsections 1, 2, 3, 4 of the election petition schedule.

Agu requested the court’s approval for the withdrawal of the petition, and the respondent in the matter did not object to the withdrawal.

He stated, “We commend the petitioner for the motion to strike out the petition and hope that more will still come.”

The counsel for the APC, Lateef Fagbemi SAN, and the counsel for the Independent National Electoral Commission (INEC), Abubakar Mahmoud SAN, also did not object to the withdrawal.

In a brief ruling, the court declared, “Having considered the application, we are satisfied that there was no collusion on the part of the respondents. The petition is hereby dismissed, having been withdrawn.”
