The supreme court has upheld late Emir Ado Bayero’s decision of sacking Aminu Babba Dan’agundi as Sarkin Dawaki Maituta and District head of Gabasawa.
The apex court on Friday decided the lingering legal tussle that lasted 17 years.
The first plaintiff, Alhaji Aminu Babba DanAgundi, was dethroned in 2003 by the Kano Emirate council, based on the report of the Makaman Kano committee which indicted the Sarkin Dawaki Maituta of alleged partisan politics, gross misconduct and indiscipline to the late Emir Ado Bayero.
It was recalled that the dethroned Sarkin Dawaki immediately filed a suit praying that the court should upturn his dismissal as he was wrongly sacked and that he was not given a fair hearing, noting that his position of Sarkin Dawaki be restored to him, as stated by his council, Barrister O. E. B Offiong, in a Kano State High Court.
However, in a ruling on Friday, Justice Mary Odili delivered the lead judgment based on the unanimous decision of the five justices of the Supreme Court.
