An Ikeja Special Offences Court on Wednesday convicted a trader, Mrs Temitope Awobeku to three years imprisonment for stealing N1.193 million from an aged man, Prof. Joseph Chike Edozie.
Justice Oluwatoyin Taiwo the court found Temitope guilty of a two-count charge brought against her by the Economic and Financial Crimes Commission (EFCC).
Delivering her judgement, Justice Taiwo held that the prosecution succeeded in proving the offence of stealing against the convict beyond a reasonable doubt.
The defence, she said, on the other hand, failed to prove that the convict is not guilty of the offences she was accused of.
The trial judge granted the convict an option of fine in the sum of N200,000 as against imprisonment.
However, Temitope must first make restitution to the complainant, Prof. Edozie in the sum of N1.193 million.
The convict was charged for obtaining money by false pretence and stealing contrary to Sections 314 and 287 of the Criminal Law of Lagos State 2015 respectfully.
According to the EFCC, the convict, with intent to defraud, convinced Prof. Joseph Chike Edozie of 162 Bamgbose Street, Lagos Island to make a transfer of the sum of N1.193 million on the understanding that the said sum was for payment of certain duties and charges to clear consignment for the complainant.
