Transparency group takes power ministry, NBET to court over alleged ₦128bn discrepancy

 

The Socio-Economic Rights and Accountability Project (SERAP) has filed a lawsuit against the Minister of Power, Adebayo Adelabu, and the Nigerian Bulk Electricity Trading Plc (NBET) over an alleged failure to account for ₦128 billion said to be missing within the power sector.

In the suit filed at the Federal High Court, Lagos, SERAP accused the minister and NBET of failing to provide a satisfactory explanation for the whereabouts and utilisation of the funds, which it said were earmarked for electricity generation and supply under the Ministry of Power.

SERAP, through its Deputy Director Kolawole Oluwadare, argued that the alleged missing funds constitute a violation of Nigerians’ right to information, transparency, and accountability as guaranteed under the 1999 Constitution (as amended) and the Freedom of Information (FOI) Act.

The organisation is asking the court to compel Adelabu and NBET to publicly disclose detailed records showing how the ₦128 billion was spent, recovered, or otherwise managed. SERAP also seeks an order directing relevant anti-corruption agencies to investigate the matter and, where appropriate, prosecute those found responsible.

According to the suit, persistent opacity in the management of power-sector funds has contributed to Nigeria’s chronic electricity crisis, despite repeated budgetary allocations and financial interventions.

As of the time of filing this report, neither the Ministry of Power nor NBET has issued an official response to the lawsuit.

The case adds to growing public scrutiny over financial management in Nigeria’s power sector, as stakeholders continue to demand reforms, accountability, and improved service delivery.
